Terms and Conditions
1. Scope of Application
These General Terms and Conditions of Business (GTCs) apply to all deliveries of the Business Division Local go Global of DITO Dienstleistungs-GmbH (hereinafter: DITO). Deliveries are made exclusively to the consumer.
Each natural person who enters into a legal transaction for a purpose which cannot be attributed to his or her commercial or self-employed professional activities is a consumer.
Deliveries are made to the countries of the European Union as well as Norway and Switzerland.
We point out that there could be country-specific additional costs for import duties, customs duties and taxes. These costs are accrued in the recipient’s country and are not included in the despatch costs quoted.

3. Offer and Steps to the Conclusion of the Contract
3.1 The presentation of the products in the online shop do not represent a legally binding offer, but an invitation to place an order. Errors excepted.
3.2 By closing the browser you can terminate the ordering process at any time. If you have logged-in to the shop with personal details, you must also log-out due to reasons of data protection.
3.3 By clicking on the buttons [Buy/order subject to charge], you are placing a binding order for the goods listed on the order page.
3.4 Receipt of the order will be confirmed by email.
3.5 Acceptance of the order takes place through despatch of the goods. You will receive the despatch information, including any necessary additional information, by email.
4. Right of Cancellation
4.1 Consumers have a fourteen day right of cancellation. You will find more necessary information under Cancellation Details Information.
4.2 The right of cancellation does not apply to the supply of goods,
1. Which are not suitable for return for reasons of health protection or hygiene if their seals have been removed after delivery,
2. If the direct packaging of foodstuffs has been opened or if the seal has been removed or damaged,
3. If, because of their nature, these have been inseparably mixed with other goods after delivery.
4.3 Returns: Please avoid damaging and contaminating the packaging and products. If possible, please return the goods to us in the original packaging with all accessories and with all parts of the packaging. If you no longer have the original packaging, please use other suitable packaging. With suitable packaging, please ensure adequate protection from damage during transportation and avoid claims for compensation due to damages as a result of defective packaging. The costs of the return will be borne by you. Please keep safe the despatch receipt of the return. In the event of the consignment being lost, transportation damage and similar, receipts are required.
4.4 Compensation Inappropriate handling of the delivered products, in particular foodstuffs and cosmetics, leads to a possible claim for compensation, including in respect of cancellation and return. Please note 4.2
5. Prices and Despatch Costs
5.1 The prices quoted on the product pages include the applicable German Value Added Tax and other price components.
5.2 In addition to the specified prices, we charge per delivery the stated, weight-dependent costs for packaging and transportation. You will be clearly notified of the despatch costs on the product pages, in the shopping basket system and again on the order page.
5.3 In respect of deliveries to countries outside Germany, there could be country-specific additional costs for import duties, customs duties and taxes. These costs are accrued in the recipient’s country and are not included in the despatch costs quoted.
Please inform yourself accordingly.
6.1 The delivery is made as a parcel with a maximum weight of 31.5 kg per package. If during ordering the weight limit is exceeded, the delivery will be made in multiple packages. The despatch costs are accounted for in the total price.
6.2 The normal delivery time amounts to between 7 and 10 working days. On request and subject to charging the additional cost, quicker delivery is possible. We will point out differing, product-related delivery times on the relevant product page and in the ordering process.
6.3 You should not accept or open consignments damaged in transportation. Shortly after receipt of the return delivery, you will receive a new delivery.
7.1 Payment can be made by credit card or via PayPal.
7.2 The designated account will be debited immediately. The delivery will be made as soon as possible or in the time desired by you.
8. Retention of Title
The goods remain our property until paid for in full.
9. Material Defect Warranty, Guarantee
9.1 The proprietor is liable for material defects pursuant to the statutory provisions applicable to this, in particular Articles 434 ff. BGB [German Civil Code].
9.2 There is a guarantee of the proprietor for individual products only if the proprietor has declared such expressly in the context of acceptance of the order by despatching the goods of the relevant article.
10.1 Claims of the consumer for compensation are excluded.
Exempted from this are claims for compensation of the customer arising from death, personal injury, damage to health or from violation of essential contractual obligations (cardinal obligations) as well as liability for other losses based on intentional or grossly negligent breach of duties by the proprietor, its legal representative or vicarious agents.
Essential contractual obligations are those the fulfilment of which is necessary to achieve the purpose of the contract.
10.2 In respect of a violation of essential contractual obligations, the proprietor is liable only for foreseeable damages typical for the contract, unless the claim to compensation of the customer concerns injury to life, body or health.
10.3 The restrictions of Clauses 10.1 and 10.2 also apply in favour of the proprietor’s legal representative and vicarious agents if claims are made directly against these.
Cancellation Details Information
Right of Cancellation
You have the right to cancel this contract within fourteen days without giving a reason. In order to exercise your right of cancellation, you must inform us,

through an explicit declaration (e.g. a letter sent by post, fax or email) of your decision to cancel this contract. In this notification, please quote the name and address of the customer as well as the invoice number and the email address in order to make identification easier for us. We will promptly confirm receipt of your declaration of cancellation by email.
The cancellation period amounts to fourteen days from the day on which you or a third party known to you, who is not the carrier, takes possession of the last of the goods.
It is sufficient for the cancellation period that you send the notification on the exercise of the right of cancellation prior to the expiration of the cancellation period.
Consequences of Cancellation
When you validly cancel the contract concluded within the period of fourteen days, we must return all payments we have received from you, including delivery costs (by standard delivery), without delay and by no later than fourteen days from the date on which your notice of the cancellation of this contract was received by us. If nothing different has been expressly agreed, the repayment takes place in the same process as the original transaction. We will not charge you a fee for the repayment.
We can refuse the repayment until we have received back the goods or until you have provided proof that you have sent the goods back, according to which is earliest.
You must return or handover the goods without delay, after exercising the right of cancellation (the cancellation made of the contract) and in each case by no later than within fourteen days from the date on which you informed us of the cancellation of the contract to:

The deadline is met if the goods are sent prior to the expiration of the period of fourteen days. You will bear the direct costs of the return of the goods.
You will have to pay for any loss in value of the goods only if this loss of value results from handling other than what is necessary to examine the goods is ascribed to you.

If you want to buy the products selected by you in the shopping basket, click on the button [to check-out]. Then, please enter your details. The obligatory details are labelled with an *. It is not necessary to register. Your details will be transmitted in an encrypted form. After entering your details and selecting the method of payment, you will be taken to the order page, where you can check your entries again, via the button [Check details]. By clicking the buttons [Buy/order subject to charge], you will finalise the ordering process. The process can be terminated at any time by closing the browser window.
Ordering Process with Registering
If you want to buy the products selected by you in the shopping basket, click on the button [to check-out]. Then, please enter your details. The obligatory details are labelled with an *.
Your details will be saved by us in internal systems for further use and for the simplification of the ordering process.
Here, there is also the opportunity to subscribe to our Newsletter, sales campaigns, special offers and the like. By re-entering your contact details for the receipt of information and additional confirmation of agreement to receive advertisements and information, you are always up to date.
The text of the contract will be saved on our internal systems. You can view the General Terms and Conditions of Business at any time on this page. The order details and the GTCs will be sent to you by email. After the order has been completed, the details of your order will no longer be available via the internet for security reasons.
